Although not yet on an American scale, class actions and group litigation are expanding in Italy, thanks to an increasingly favourable procedural environment and the increasing presence of specialist players, funding and managing complex mass litigations.

The vast majority of cases stem out of investigations of the competition and market authorities (finding competition law breaches or unfair commercial practices) or concern product liability issues. Trevisan & Cuonzo is uniquely positioned to support clients in all such areas, core practices of the firm.

The firm can count on its strong litigation capabilities, its deep knowledge of the substantive matters typically at stake and its experience before the Commercial Chamber of the Court of Milan, which currently hears the vast majority of class actions and group litigations.

The litigators of the firm have handled hundreds of cases before the Milan Commercial Chamber in the last 30 years, in IP, unfair competition and antitrust related matters (all core practices of the firm fall within the jurisdiction of the Milan Commercial Chamber). This gives the team first-hand experience on crucial substantive and case management issues, such as expert selection, expert management, confidentiality management, discovery orders, etc.

Cases have been handled on both sides of the spectrum (i.e for both defendants and plaintiffs), which gives the team strong knowledge of the dynamics and the financial incentives that guide all actors involved.

Recent notable cases:

  • Acting on behalf of one of the leading claim aggregators in Europe in an action concerning the compensation of damages suffered by hundreds of companies as a result of the corrugated cardboard cartel fined by the Italian Competition Authority
  • Assisting a leading Italian consortium for plastic recycling (with over 2.000 members) to defend it in a follow-on action for damages allegedly arising from an abuse of dominant position brought in early 2025 by the main competing consortium
  • Assisting a National Association, which represents multiple companies operating in a private health sector, before the Italian Competition Authority (AGCM) in proceedings against a National Register Committee.
